Beth McMahon

Beth represents her clients in litigation in both state and federal court on a wide range of civil matters, including business torts, breach of contract, intellectual property, securities, and environmental litigation. 
 
Beth has significant courtroom experience and specific familiarity with the rules and procedures of the federal courts in the Eastern District of Virginia (EDVA) where she worked as a staff attorney for six years. She also practiced as a partner in the trial section of one of Virginia’s premier law firms, frequently representing clients in the EDVA as well as state and other federal courts.  Her experience makes her uniquely qualified for trial counsel and local counsel work in Virginia courts.
 
Whether in a courtroom, in mediation, or in arbitration, Beth helps her clients develop strategies to streamline and simplify disputes and resolve litigation when possible.  Because she is an experienced litigator, when trial cannot be avoided, Beth is ready to represent her clients in court before a judge or jury.

Experience

Federal and State Litigation, including both judge and jury trials throughout the Commonwealth of Virginia, with significant experience in the EDVA
Represented individuals in white collar criminal cases, notably obtaining a Hyde Amendment award upon a finding that the government’s prosecution of defendants was vexatious (U.S. v. Holland, 34 F. Supp. 2d 346 (E.D. Va. 1999), and U.S. v. Holland, 214 F.3d 523 (4th Cir. 2000))
Handled appeals at the Virginia Supreme Court and the United States Court of Appeals for the Fourth Circuit, including amicus filings before the United States Supreme Court
Significant experience in trusts and estates and fiduciary litigation, notably obtaining a Virginia Supreme Court affirmance of the trial court’s full award of a widower’s augmented estate claim (Chappell v. Perkins, 266 Va. 413, 587 S.E.2d 584 (2003))
